Terms and Conditions

1. User Requirements and Access to the Services

Use of the Platform is permitted to users of all ages. However:

  • Purchases and Registration: To make purchases in the events section or to register in reserved areas, the user must be at least 18 years old or act under the supervision of an adult.

  • Acceptance: By using the Platform, you declare that you have the legal capacity to accept these Terms.

2. Intellectual Property and Copyright

All the material on the Platform (texts of the Pozzallo 2026 Dossier, logos, software, photographs, videos and graphics) is the exclusive property of Nova Proloco Pozzallo APS and IMMAGINA ADV.

  • Restrictions: It is prohibited to copy, modify, distribute or use the contents for commercial purposes or to favor projects in competing territories without written authorization.

  • Copyright: Any violation of intellectual property will be prosecuted pursuant to Law 633/1941.

3. Modification of the Offer and Services

Nova Proloco Pozzallo APS reserves the right to:

  • Change, suspend or interrupt any service or feature of the Web-App (e.g. guided tours, access to areas of the Blog at any time and without notice.

  • Update the rates of paid events, ensuring that the price applied is the one indicated at the time of purchase.

4. Payments and Transactions (Events Section)

For the purchase of tickets or services via the Platform:

  • Payment Methods: The main circuits are accepted (Credit/Debit Cards, PayPal, Stripe) managed through secure encrypted systems.

  • Responsibility: The user guarantees that he is the owner of the payment method used.

  • Confirmation: The purchase is confirmed only after sending the receipt email containing the entry ticket.

  • Refunds and Cancellations: The purchase of tickets, services or the payment of membership fees is governed by the official Refund and Return Policy of the Platform. The user is required to read it before each transaction. In particular, membership fees, given their associative nature, are not refundable once registration is completed.

5. Suspension and Cancellation of Accounts

We reserve the right to permanently suspend or cancel the access of a registered user or member, without notice, if:

  • You violate these Terms.

  • The user uses the Platform for illicit or harmful activities for the image of the city of Pozzallo.

  • There are attempts at computer intrusion (hacking) in the Web-App databases.

6. Warranties and Limitation of Liability

  • Warranties: The Platform is provided "as is". Although IMMAGINA ADV guarantees basic assistance for system recovery, it is not guaranteed that the service is free of temporary interruptions due to third-party suppliers (Wix, Aruba).

  • Contents: Event information is provided by the organizers. Nova Proloco Pozzallo APS is not responsible for inaccuracies or program changes not promptly communicated.

  • Mobile use: The user is responsible for the use of the device during pedestrian or road navigation via the Web-App.

8. Dispute Resolution (ODR) and Competent Court

In accordance with EU rules, consumer users can use the ODR (Online Dispute Resolution) platform for disputes related to online purchases: http://ec.europa.eu/consumers/odr/. Any legal dispute will be subject exclusively to Italian law and the jurisdiction of the Court of Ragusa.
